People often see a conveyancer and a solicitor as being one and the same.

This is not true.

A conveyancer understands the scenario that surrounds the exchange (purchase or sale) of a property. They can affect a transaction that is purchase or sale related but not more than that.

They are not equipped to handle, for example, implications that may arise from sale such as tax.

 

A solicitor is a step up from a conveyancer

A solicitor understands the process by which a property may be exchanged – purchased or sold.

They also understand the legal implications that a sale can bring with it – such as payment of capital gains tax or payment of proceeds to a spouse or ex-spouse.

 

Conveyancer or solicitor – which one should you choose while buying or selling a property?

The truth is – it all depends.

If you’re a first home buyer, and the purchase of your home is relatively straightforward, then go with a conveyancer. They will understand your requirement and quickly and efficiently undertake it for you.

If your purchase or sale is complicated – involves multiple properties, an investment portfolio or a series of properties that are negatively geared, then you should be going with a solicitor not a conveyancer.

They will have the necessary skills you need to ensure your property exchange happens smoothly, efficiently and with no hiccups along the way.
